California Notice at Collection

The Dark Olive collects the following categories of personal information: identifiers (name, email, address, phone), commercial information (products purchased or browsed), internet activity (browsing and interaction data), geolocation (IP-based, approximate), and inferences drawn from this information. We use this information to fulfill orders, operate our website, communicate with you, prevent fraud, and — with your consent — for analytics and advertising. We do not sell personal information for money. We do share certain personal information with advertising partners (Google, Meta, TikTok, Pinterest) for cross-context behavioral advertising; California residents have the right to opt out of this sharing. We retain personal information only as long as necessary for these purposes, as described in Section 9 below.

1. Introduction

Welcome to The Dark Olive. Your trust and privacy are foundational to our brand. This Privacy Policy explains how we collect, use, protect, and share your personal information when you visit, browse, or make a purchase from thedarkolive.com (the “Site”). By using our Site, you agree to the practices described in this policy. If you do not agree, please do not use the Site.

2. Information We Collect

A. Information you provide directly

  • Identifiers: name, email address, phone number, billing address, shipping address.
  • Account information: if you create an account, your username and password (passwords are stored hashed, not in plain text).
  • Commercial information: records of products you have purchased, viewed, or added to your cart.
  • Communications data: information you provide when you contact us, leave reviews, complete our product quiz, or subscribe to our email list.
  • Marketing subscriptions: your email address and first name when you opt in to our newsletter.

B. Information collected automatically

  • Usage data: IP address, browser type and version, device information, time zone, operating system, language preference.
  • Store activity: products you have viewed, items in your cart, session duration, pages visited.
  • Approximate location: derived from your IP address for tax and shipping calculation. We do not collect precise geolocation.

C. Sensitive personal information

Because of the nature of our products, information about your purchases, browsing, or quiz responses could be used to infer information about your sex life. California law treats this as sensitive personal information. We treat this information with heightened care:

  • We use it solely to fulfill your order, provide customer support, and operate our Site.
  • We do not use sensitive personal information to infer characteristics about you for advertising.
  • When we deploy advertising tools (such as the Meta Pixel, TikTok Pixel, Pinterest tag, or Google Ads tags), we configure them to transmit only generic event signals (such as “Purchase” or “AddToCart”) without sensitive product detail.
  • California residents have the right to limit our use and disclosure of sensitive personal information. See Section 10.

D. Payment information

When you make a purchase, your payment details are submitted directly to our PCI-compliant payment processors (Stripe and PayPal). The Dark Olive does not store your full card number on our servers. We receive only the information necessary to confirm and reconcile your order (typically the last four digits and a transaction reference).

E. Information from third parties

We may receive information about you from payment processors, analytics providers, email marketing platforms, and advertising partners. This information is used to verify transactions, measure our marketing, and improve your experience. The full list of third parties is in Section 8.

3. How We Use Your Information

We use personal information for the following purposes:

  • Order fulfillment — to process payments, ship products, calculate taxes, and manage returns.
  • Account management — to set up and maintain your account.
  • Customer support — to respond to inquiries, refunds, and complaints.
  • Marketing — to send you email communications, only if you have opted in. You may unsubscribe at any time.
  • Analytics — to understand how visitors use our Site, with your consent for non-essential analytics cookies.
  • Advertising — to deliver and measure ads on Google, Meta, TikTok, and Pinterest, with your consent.
  • Security and fraud prevention — to protect our Site, customers, and business.
  • Legal compliance — to comply with applicable laws, regulations, and legal processes.

4. Cookies and Tracking Technologies

We use cookies and similar technologies to operate our Site, analyze usage, and (with your consent) deliver and measure advertising. We use four categories of cookies:

  • Essential cookies — required for the Site to function (shopping cart, checkout, login session, age verification). These cannot be disabled.
  • Analytics cookies — help us understand how visitors use our Site (Google Analytics 4). Set only with consent.
  • Marketing cookies — deliver and measure advertising on Google, Meta, TikTok, and Pinterest. Set only with consent.
  • Preference cookies — remember your settings (language, login state). Some are essential; others require consent.

Our cookie consent banner allows you to accept or reject each non-essential category. You can change your preferences at any time using the “Your Privacy Choices” link in our website footer. We honor the Global Privacy Control (GPC) signal as a valid opt-out request from California residents.

5. Email Marketing and Communications

5.1 Consent

We send marketing emails only to individuals who have provided explicit, affirmative consent by checking the consent box on our email signup form. We record your consent along with a timestamp and your IP address as proof of opt-in.

5.2 What we send

Our marketing emails may include:

  • New product announcements
  • Exclusive offers and discounts
  • Intimate wellness education and editorial content
  • Brand news and updates

Every marketing email identifies The Dark Olive as the sender, includes our physical mailing address, and contains a working unsubscribe link.

5.3 How to unsubscribe

We process opt-out requests within 10 business days, as required by the CAN-SPAM Act. Unsubscribing from marketing emails does not affect transactional emails (order confirmations, shipping notices).

5.4 Email service provider

We use Brevo to manage our subscriber list and deliver emails. Brevo processes engagement metrics (open rates, click rates) on our behalf under a data processing agreement. Brevo does not use your data for its own marketing purposes.

5.5 We do not sell your email

We will never sell, rent, or share your email address with third parties for their own marketing purposes.

6. Comments and Reviews

When you leave a comment or review, we collect the data shown in the form, your IP address, and your browser user agent for spam detection. An anonymized hash of your email may be sent to Gravatar to display your avatar (see Gravatar’s privacy policy at automattic.com/privacy/). If you upload images, avoid uploading images with embedded location data (EXIF GPS), as visitors can extract this metadata from public images.

Cross-context behavioral advertising. When you consent to marketing cookies, we share limited information with the platforms above (typically: your hashed email if available, your IP address, the page you visited, and the action you took) so they can deliver more relevant ads to you across their networks. California residents have the right to opt out of this sharing — see Section 10.

8. Who We Share Your Data With

We share information with the following categories of recipients:

  • Service providers — payment processors, hosting providers, email service, analytics providers, customer support tools. They are contractually obligated to use your information only to provide services to us.
  • Advertising partners — Google, Meta, TikTok, and Pinterest, as described in Section 7. California treats some of this as “sharing” for cross-context behavioral advertising.
  • Legal and safety — we may disclose information to comply with the law, respond to lawful requests, protect our rights, prevent fraud, or protect the safety of our users or the public.
  • Business transfers — if we are involved in a merger, acquisition, or sale of assets, your information may be transferred. You will be notified of any change in control.

8.1 No sale of mobile data

Important: No mobile information will be shared with third parties or affiliates for their marketing or promotional purposes. All other categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

8.2 We do not sell personal information for money

We do not sell personal information in exchange for monetary consideration. However, the sharing of information with advertising partners described in Section 7 may meet California’s broader definition of “sale” or “sharing” — California residents may opt out using the mechanisms in Section 10.

9. Data Retention

We retain personal information only as long as necessary for the purposes for which it was collected:

  • Order records: 3 years for tax and accounting purposes (longer if required by law).
  • Account data: until you request deletion of your account.
  • Email subscribers: until you unsubscribe; consent records may be retained longer to demonstrate compliance.
  • Comments and reviews: retained indefinitely so we can recognize follow-up activity, unless you request deletion.
  • Analytics data: retained in anonymized or aggregated form. Identifiable analytics data is retained for no more than 14 months in Google Analytics 4.
  • Cookie consent records: retained for 24 months as proof of consent.

10. Your Privacy Rights

10.1 California residents (CCPA / CPRA)

If you are a California resident, you have the following rights:

  • Right to Know — request a copy of the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of recipients.
  • Right to Delete — request deletion of your personal information, subject to legal exceptions.
  • Right to Correct — request correction of inaccurate personal information.
  • Right to Opt Out of Sale or Sharing — direct us not to sell or share your personal information for cross-context behavioral advertising. We honor the Global Privacy Control (GPC) signal as a valid opt-out.
  • Right to Limit Use of Sensitive Personal Information — direct us to limit our use and disclosure of sensitive personal information to purposes necessary to provide our products and services.
  • Right to Non-Discrimination — we will not discriminate against you for exercising any of these rights.

How to exercise these rights:

  • Use the “Your Privacy Choices” link in our website footer for opt-out and limit requests (handled automatically through our consent platform).
  • Email privacy@thedarkolive.com for all other requests.

We respond to verifiable requests within 45 days. If we need additional time (up to 45 additional days), we will notify you in writing. You may designate an authorized agent; we may require verification of the authorization before processing the request.

10.2 Other US states

Residents of Virginia, Colorado, Connecticut, Texas, Oregon, and other states with comprehensive privacy laws have substantially similar rights to those listed above. The same contact methods apply.

10.3 California “Shine the Light” Law

Under California Civil Code Section 1798.83, California residents may request information regarding our disclosure of personal information to third parties for their direct marketing purposes. We do not currently disclose personal information for third-party direct marketing.

11. Do Not Track and Global Privacy Control

Some web browsers offer a “Do Not Track” (DNT) feature. Because there is no uniform standard for interpreting DNT signals, we do not currently respond to them. However, we do honor the Global Privacy Control (GPC) signal as a valid opt-out of sale or sharing for California residents. When our website detects a GPC signal from your browser, we will treat it as a request to opt out of cross-context behavioral advertising for that visit.

12. International Users

Our Site is operated from the United States and we currently ship only within the United States. If you access the Site from outside the US, your information will be transferred to and processed in the United States. By using our Site, you consent to this transfer.

13. Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information, including:

  • SSL/TLS encryption across the Site
  • Hashed password storage
  • Restricted access on a need-to-know basis
  • PCI-compliant payment processing through Stripe and PayPal
  • Regular security reviews and software updates

No method of transmission or storage is 100% secure. If you have reason to believe your interaction with us is no longer secure, contact us immediately at privacy@thedarkolive.com.

14. Children’s Privacy

Our Site and products are intended exclusively for individuals 18 years of age or older. We do not knowingly collect personal information from anyone under 18. Our Site features an age verification gate to confirm visitor eligibility. If we learn we have collected information from a person under 18, we will delete it. If you believe a minor has provided us with personal information, contact privacy@thedarkolive.com.

15. Third-Party Links

Our Site may contain links to third-party websites. We are not responsible for the privacy practices of these sites. We encourage you to review their privacy policies.

16. SMS / Text Messaging

We do not currently offer SMS marketing. If we offer SMS in the future:

  • You will receive marketing texts only if you have expressly opted in.
  • Message and data rates may apply. Message frequency varies.
  • You may opt out at any time by replying STOP or contacting privacy@thedarkolive.com.
  • No mobile information will be shared with third parties for their own marketing purposes.

17. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the Effective Date and Last Updated dates and, where appropriate, notify you by email or through a notice on our Site.
